GENERAL CONDITIONS OF USE OF THE SITE AND DESCRIPTION OF SERVICES PROVIDED

The purpose of this website is to provide information on the activities of EKIUM GROUP and its affiliated companies. These conditions of use may be modified or supplemented at any time, and users of the site are therefore invited to consult them on a regular basis.



LIABILITY - EXCLUSION

EKIUM GROUP disclaims all liability for material damage related to the use of its site as well as for the unavailability of certain features and/or the presence of viruses.

Furthermore, EKIUM GROUP endeavours to provide information on its site that is as precise and accurate as possible. However, in the event of omissions, inaccuracies and shortcomings in updating, whether caused by EKIUM GROUP or by the third party partners who provide it with this information, EKIUM GROUP’s liability may not be invoked under any circumstances, as users of the site acknowledge that all the information indicated on the site is given as an indication and general information, and may be subject to change. Furthermore, the information on the site is not exhaustive. It is given subject to modifications that may be made after it has been put online. Consequently, the user of the site acknowledges that he or she uses the information visible on the site under his or her sole responsibility without ever being able to call into question the responsibility of EKIUM GROUP in any capacity whatsoever.

INTELLECTUAL PROPERTY

The structure of the site as well as all the information contained on the site are the exclusive property of EKIUM GROUP and its affiliates. They are subject to the provisions of the Intellectual Property Code.

Any total or partial reproduction, extraction, reuse or exploitation of the content and information on the site without the prior authorisation of EKIUM GROUP is strictly prohibited and constitutes an infringement in accordance with the provisions of the Intellectual Property Code.

Furthermore, the trademarks, logos, visual signs of EKIUM GROUP, its affiliates and its partners are also the exclusive property of EKIUM GROUP and its partners. Consequently, any reproduction and/or use, in whole or in part, of these trademarks, logos and visual signs without the prior and express consent of EKIUM is strictly prohibited.

In the event that documents are made available on the site, the user may download a copy but only and exclusively for strictly private use.

INFORMATION TECHNOLOGY AND FREEDOM

In accordance with the “Data Protection and Civil Liberties” law of 6 January 1978 (art.27) amended by the law of 6 August 2004, the user of the site is informed that EKIUM GROUP collects and processes information available through the contact forms (Clients and Candidates) available online as filled out by the User.

This information may be as follows : First name, surname, position, company, e-mail, address, town, telephone, information relating to recruitment (level of education, CV, etc.). They are stored temporarily in order to carry out actions such as mailings, calls, invitations to events or sending commercial presentations.

As such, and in accordance with the French Data Protection Act and the RGPD (General Data Protection Regulations dated 25 May 2018), the User may :

– Request a right of access to his data: please specify in your request which data or processing operations it relates to. (Article 15 of the DPMR)

– Request a right of rectification: if the user believes that certain information is erroneous and should be rectified. (Article 16 of the DPMR)

– Requesting a right of deletion: the user must indicate precisely the data concerning him/her for which he/she requests deletion, and the reasons for the request (Article 17 of the DPMR). Please note: this right is not absolute, EKIUM GROUP may be obliged to keep information.

– To request a limitation of processing: it is necessary to indicate precisely the data for which the limitation of processing is requested, and the reasons for the request. (Article 18 of the RGPD) Note: this right is not absolute.

– Request a right to object: it is necessary to indicate precisely the processing for which the user objects to the management of his/her personal data, and the reasons for the request (Article 21 of the GDPM). Note: this right is not absolute.

The user may exercise this right by sending a request by post, accompanied by a copy of an identity document bearing his signature, to : EKIUM GROUP, 5 Rue Abraham Bloch, CS 90422, 69364 Lyon CEDEX 07 (France).

EKIUM GROUP is the recipient of the information it collects through its contact forms. Under no circumstances may this information be transmitted to third parties, in particular for commercial prospecting purposes. Furthermore, EKIUM GROUP undertakes to respect the confidentiality of this information and to use it only to respond to requests from the user who has entered the information on the site.

USE OF COOKIES

The user of the site is informed that browsing the EKIUM GROUP site may cause cookies to be installed on the user’s computer.

A cookie is a block of data that does not allow users to be identified but which records information relating to the navigation of a computer on a site during a given period. The data thus collected is intended to facilitate subsequent navigation on the site.

The cookies used on the site meet the requirements of the European Union’s “General Data Protection Regulation Cookie Compliance”. Their duration is less than the recommendations of the CNIL (13 months).

Applicable law and competent jurisdiction

Any dispute relating to the use of the EKIUM GROUP site is subject to French law and to the exclusive jurisdiction of the courts within the jurisdiction of the Lyon Court of Appeal.
